‘Change Whitefield To Darkfield’: Karnataka High Court Raps Cops Over Illegal Detention

BENGALURU: In a sharp rebuke of law enforcement practices in the tech corridor, the Karnataka High Court on Monday come down heavily on the Whitefield police, suggesting the police station be renamed “Darkfield” for unlawfully detaining an individual before his legal deadline to present himself had even lapsed.

A bench presided over by Justice M Nagaprasanna expressed strong displeasure over the police’s premature action against a resident who was picked up over a social media post linked to the cancellation of stand-up comedian Kunal Kamra’s show.

“Change the name from Whitefield to Darkfield police station,” Justice Nagaprasanna remarked sharply in open court. “Is this the way to exercise police powers? Should a court tutor you?”

The scathing observation was directed at Whitefield Police Inspector and Investigating Officer Preetham, Assistant Commissioner of Police (ACP) N Reena Suvarna, and Deputy Commissioner of Police (DCP) Saidulu Adavath, who were summoned and present in the courtroom.

Summoned Before Deadline Expired

The judicial intervention came during the hearing of a petition filed by Mohan Gowda, an Udupi resident associated with the Hindu Rashtra Samanvaya Samithi.

Gowda had publicly opposed comedian Kunal Kamra’s scheduled performance at ‘Uru’ in Whitefield. Following the eventual cancellation of the show, Gowda posted a statement on Facebook describing the cancellation as a “victory for Hindu unity.”

Taking note of the post, a constable at the Whitefield police station registered a suo motu complaint, alleging that the online message carried an apprehension of threat to communal harmony.

Subsequently, the police issued a procedural notice to Gowda, directing him to appear before the investigating officer within a three-day window. However, before the stipulated 72-hour period expired, police officers allegedly picked up Gowda in advance, bypassing due process.

Procedural Misconduct Under Scrutiny

Faced with the premature detention, Gowda immediately moved the High Court seeking relief against the law enforcement agency’s actions.

During the proceedings, the High Court questioned the necessity and legality of snatching away an individual’s liberty before giving them the full opportunity to comply with official notices issued under statutory provisions.

The court’s stern reprimand highlights growing judicial oversight on police personnel filing suo motu cases and executing premature arrests or detentions without strictly adhering to procedural timelines.
