Supreme Court Quashes Land Allotment Corruption Case Against Karnataka BJP Leader R. Ashoka, Calls It ‘Politically Motivated’

In a major legal and political development, the Supreme Court on Tuesday (December 16) quashed the corruption case against Karnataka Leader of Opposition and BJP MLA R. Ashoka, holding that the proceedings were politically motivated, legally barred, and initiated in bad faith.

The case related to alleged irregularities in land allotments during Ashoka’s tenure as Chairman of the Committee for the Regularisation of Unauthorised Occupation of Government Land. An FIR had been registered by the State Anti-Corruption Bureau (ACB), accusing Ashoka of facilitating illegal allotment of government land meant for SC/ST communities and the poor to his family members, political supporters, and corporators.

Ashoka had approached the Supreme Court after the Karnataka High Court refused to quash the FIR.

No Sanction, No Case: Supreme Court

Allowing the appeal, a bench of Justices Sanjay Karol and Vipul M. Pancholi set aside the High Court’s order, holding that the entire prosecution was vitiated due to the absence of mandatory sanction from the State Government, as required under law to prosecute a public servant.

The court noted that no investigation could have legally commenced without such sanction, making the ACB’s preliminary report, FIR, and all subsequent proceedings unsustainable.

“The record is conspicuously silent on any sanction having been obtained against the appellant. Since no investigation could have begun without such sanction, the preliminary report of the ACB, subsequent FIR and any and all proceedings thereafter have operated in the face of an express bar,” the bench observed.

Lokayukta Cleared Ashoka—Twice

In a strong indictment of the prosecution’s conduct, the Supreme Court highlighted that the Lokayukta had on two separate occasions found no material to proceed against Ashoka on identical allegations.

Justice Karol, who authored the judgment, noted that the FIR was nothing more than a repackaging of stale allegations, filed despite repeated exoneration by a competent quasi-judicial authority.

“The actions against the appellant ex facie appear to be politically motivated and thereby afflicted by malice,” the court held, adding that even leaving aside the issue of delay, the prosecution could not have proceeded in the eyes of the law.

The bench further observed that three complaints raising the same allegations had been filed, and yet no fresh or credible material was brought on record to justify reopening the matter.

Judicial Warning Against Abuse of Process

The judgment underscored an important legal principle—that exoneration by bodies like the Lokayukta cannot be casually disregarded unless supported by new and substantive evidence.

By allowing the appeal, the Supreme Court sent a clear message against the misuse of investigative agencies for political ends, particularly in cases involving elected representatives.
